LTS-flyfishing reserves the right to change prices and terms. Any changes will be clearly stated before the product is purchased. Delivery of the products will be in the manner, at the place and at the time stated in the order confirmation.
LTS-flyfishing bears the risk for the products until delivery of the goods or services to the customer or representative designated by the customer. Delivery is deemed to have occurred when the customer, or their representative, has received the goods or services in their possession.
If the delivery of the product is delayed, LTS-flyfishing will provide the customer with information as soon as LTS-flyfishing has knowledge of it, along with information about and possibly when delivery can take place, or whether the product is out of stock.
Depending on the nature of the product and the length of the delay, the customer may, depending on the circumstances, demand delivery, demand compensation or terminate the agreement.
If the delivery time is not stated in the order solution, LTS-flyfishing shall deliver the goods to the buyer without undue delay and no later than 30 days after the order from the customer. The goods shall be delivered to the buyer unless otherwise specifically agreed between the parties.
Right of withdrawal
Unless the agreement is exempt from the right of withdrawal, the buyer may cancel the purchase of the item in accordance with the Right of Withdrawal Act.
The buyer must notify LTS-Flyfishing of the exercise of the right of withdrawal within 14 days from the start of the period. The period includes all calendar days. If the period ends on a Saturday, public holiday or public holiday, the period is extended to the nearest working day.
The cancellation period is considered to have been met if notification is sent before the expiry of the period. The buyer has the burden of proof that the right of cancellation has been exercised, and the notification should therefore be made in writing (cancellation form, email or letter).
The withdrawal period begins to run:
• When purchasing individual items, the cancellation period will run from the day after the item(s) are delivered.
• If the purchase consists of several deliveries, the cancellation period will run from the day after the last delivery has been delivered. When exercising the right of cancellation, the goods must be returned to LTS-Flyfishing without undue delay and no later than 14 days from the notification of the exercise of the right of cancellation. The buyer must cover the direct costs of returning the goods. In addition to the direct return costs, the buyer will not be charged any additional costs as a result of the buyer exercising the right of cancellation, as long as the goods are returned in the same condition and quantity as they were received. The buyer may test or examine the goods in a reasonable manner to determine the nature, properties and function of the goods, without the right of cancellation lapse. If testing or examining the goods goes beyond what is reasonable and necessary, the buyer may be liable for any reduced value of the goods.
When exercising the right of withdrawal, LTS-Flyfishing will refund the purchase price no later than 14 days from LTS-Flyfishing receiving notification of the buyer's decision to exercise the right of withdrawal. LTS-Flyfishing has the right to withhold payment until the goods have been received from the buyer or until the buyer has provided documentation that the goods have been returned.
• Delay and non-delivery – buyers' rights and deadline for filing claims
If LTS-Flyfishing does not deliver the goods or delivers them late in accordance with the agreement between the parties, and this is not due to the buyer or circumstances on the buyer's side, the buyer may, in accordance with the rules in Chapter 5 of the Consumer Purchase Act, withhold the purchase price, demand fulfillment, terminate the agreement and/or demand compensation from LTS-Flyfishing, depending on the circumstances.
When claiming default powers, the notification should be in writing (for example, email) for evidentiary reasons.
